Privacy and cookie statement

1.               Introduction

We see it as our responsibility to guard your privacy as much as possible and to be transparent on the use of your Personal Data.

With these Conditions we inform you about the Personal Data that we collect on the different parts of our Website, why we collect and Process this Personal Data and on the basis of which ground as mentioned in article 6 GDPR. We also inform you on how we process your Personal Data.

Intergas: Intergas Verwarming B.V., registered with the Dutch Chamber of Commerce (KvK) under number 04068371.

Website: The website that can be found via www.intergasverwarming.nl and any subpages thereof.

GDPR: Regulation (EU) 2016/679 of the European Parliament and the council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation)

Conditions: This Privacy and Cookie Statement + Disclaimer and any amended versions thereof.

Controller: Controller as defined in article 4 paragraph 7 of the GDPR.

Cookies: Cookies and scripts.

Data Subject: The data subject as defined in article 4 paragraph 1 of the GDPR.

Personal Data: Personal data as defined in article 4 paragraph 1 of the GDPR.

Processor: Processor as defined in article 4 paragraph 8 of the GDPR.

Processing: Processing as defined in article 4 paragraph 2 of the GDPR.

3.               Purpose and ground of the Processing of Personal Data on the Website

3.1.           Warranty card

If you use the Website to register a warranty card you are required to fill in a form. With this form Intergas Processes the following Personal Data (that is received from you).

Intergas needs to Process this Personal Data to be able to answer your questions regarding the use or operation of your heater quickly and accurately.

Intergas will delete this Personal Data after 15 years as this is the warranty period on certain parts.

3.2.           Receive Literature by post form

When you would like to receive any literature from Intergas you can fill in the designated form. With this form Intergas Processes the Personal Data as provided with the form. Processing this Personal Data is required in order to fulfill your request. Intergas will delete the Personal Data after the documentation has been sent to you.

3.3.           Application form

When you would like to send in an open application or apply for a specific job mentioned on the Website you are required to fill in a form. With this form Intergas Processes the Personal Data as provided with the form.

Intergas requires this Personal Data to review your application and contact you about your application. Intergas will Process the Personal Data you provided solely for this purpose. Intergas will delete your Personal Data 4 weeks after the application procedure has ended.

3.4.           Request training form

When you would like to receive any training from Intergas you are required to fill in a form. With this form Intergas Processes the Personal Data as provided with the form.

Intergas requires this Personal Data to contact you regarding the training and to provide the training services. Intergas will Process the Personal Data you provided solely for this purpose. Intergas will delete this Personal Data as soon as the training services have been provided.

3.5.           Training Evaluation Form

When you would like to give feedback this user is required to fill in a form. With this form Intergas Processes your e-mail address and your feedback to evaluate the training. Your feedback will be kept to improve our training, your email address will be deleted 4 weeks after your feedback is received

3.6.           Cookies on the Website

Websites use practical and useful technics which enhance usability and make the website as interesting as possible for each visitor. Commonly used technics are Cookies, which can be used by website hosts or third parties – for example advertisers – who communicate through the website you visit.

It is of great importance to us that you are aware which Cookies our Website uses and for which purposes they are used. Our intention is to guard your privacy as much as possible when providing for the best user experience. Below you can read more about the Cookies that our Website uses and the purposes they are used for.

3.6.1.       Analytical Cookies

In order to determine which parts of the Website are the most interesting for our Website’s users we continuously monitor the amount of users on the Website and which part of the Website they are viewing.

The information collected is processed into statistics. These statistics provide us with an insight into how many times our Website is visited and which part of the Website the users spend the most time on. This allows us to improve the structure, navigation and content of the Website in order to provide for the best user experience. The statistics and reports generated cannot be traced back to individual users.

Our Website uses functional Cookies. These Cookies are essential to make the Website run properly. We use these Cookies to enable you to navigate the Website, to provide access to secured areas of the Website and to save user settings and preferences like the preferred language.

3.6.3.       Social media Cookies

Our Website enables you to share information from our Website through social media by using the social media buttons on the Website. By clicking on these social media buttons you will be redirected to the website of the social media company which’ button you clicked on. As soon as you click on a social media button, the social media company involved will place a cookie on your device instantly. Our Website uses Cookies to track visitors to allow us to show information as relevant for you as possible. We explicitly request your consent for the use of the following Cookies.

3.6.5.       Browser settings

If you don’t want any Cookies to be places on your computer you can changes your browser’s settings to get a warning before any Cookies are placed. Also you can adjust your browsers settings in such a way that all Cookies or for instance third party cookies are disabled. It is also possible to delete Cookies that already have been places. These settings have to be made for each browser and each PC separately.

If you don’t allow our Cookies it is possible that our Website will not function properly or that our website will not be visible at all. Also any advertisements will no longer be personalized.

4.               Providing Personal Data to third parties

The Personal Data that is acquired by Intergas via the Website will only be shared with the following parties:

Sub-contractors (including Processors as defined in the GDPR) that are used by Intergas to provide the services that are offered via the Website and that cannot be performed by Intergas itself.
Group Companies of Intergas.
Intergas has concluded agreements or will conclude agreements with these third parties that meet the requirements of the GDPR.

5.               Rights of the Data Subject

Right of access

The Data Subject has the right to be informed, at the Data Subject’s request, by Intergas on whether or not Personal Data of the Data Subject are Processed by Intergas, and if this is the case to receive access to this Personal Data. Intergas will provide the Data Subject, at the Data Subject’s request, with a copy of the Personal Data that is Processed by Intergas. If additional copies are requested, Intergas will apply a reasonable charge that is based on the real administrative costs of Intergas.

Right to rectification

The Data Subject has the right to obtain from Intergas, without undue delay, the rectification of inaccurate Personal Data concerning him or her. Taking into account the purposes of the Processing, the Data Subject shall have the right to have incomplete Personal Data completed, including by means of providing a supplementary statement.

Right to erasure (‘right to be forgotten’)

Intergas will, at the request of the Data Subject, without undue delay erase Personal Data concerning him or her in case:

the Personal Data are no longer necessary in relation to the purposes for which they were collected or otherwise Processed;
the Data Subject objects to the processing pursuant to article 21 paragraph 1 GDPR and there are no overriding legitimate grounds for the Processing, or the Data Subject objects to the processing pursuant to article 21 paragraph 2 GDPR;
the Personal Data have been unlawfully processed ;
the Personal Data have to be erased for compliance with a legal obligation in Union or Member State law to which the Controller is subject;;
the personal data have been collected in relation to the offer of information society services referred to in article 8 paragraph 1 GDPR.
The Data Subject should realize that objecting to the Processing of Personal Data as described in these Condition may lead to the situation that Intergas will no longer be able to fulfill its obligations in relation to the Data Subject.

Right to restriction of processing

Intergas will, at the request of the Data Subject, without undue delay restrict Personal Data concerning him or her in case:

the accuracy of the Personal Data is contested by the Data Subject, for a period enabling Intergas to verify the accuracy of the Personal Data;
the Processing is unlawful and the Data Subject opposes the erasure of the Personal Data and requests the restriction of their use instead;
Intergas no longer needs the Personal Data for the purposes of the Processing, but they are required by the Data Subject for the establishment, exercise or defense of legal claims;
the Data Subject has objected to processing pursuant to article 21 paragraph 1 pending the verification whether the legitimate grounds of Intergas override those of the Data Subject.

6.               Complaints

The Data Subject has the right to complain with the supervisory authorities (in the Netherlands: The Dutch Data Protection Authority (DPA) , https://autoriteitpersoonsgegevens.nl/en/).

7.               Disclaimer / liability

7.1.           General

With this disclaimer we inform you about the conditions that apply to the information that is provided on or via our Website.

7.2.           Intellectual Property

The content of the Website and all information thereon, including, text, photo’s, video’s, illustration, drawings, graphic designed, trade names and logos (hereinafter: the “Works”) are protect by copyright laws.

The copy right to these Works is held by Intergas or by parties that have provided Intergas with a license for the use of the Works.

It is strictly prohibited to, apart from visiting the Website, copy, transfer, edit, distribute or otherwise make use of the Works without the prior written consent of Intergas.

7.3.           No guarantees / limitation of liability

It is Intergas’ intention to provide the users of the Website with accurate information. Despite all efforts it is however possible that the Website contains inaccurate or outdated information. The information on the Website is provided without any guarantee as to its validity.

The information on the Website is purely general informational and therefore does not contain specific (technical) advise. The information might be outdated.

Intergas reserves all rights to change or delete the contents of the Website without prior notice to the user.

Intergas is not responsible for (and not liable for any damages that are the result of) the content of third party websites that link/refer to the Website or to which the Website links/refers. Intergas has no control over the content of third party websites.

Intergas is not liable for damages that are the result of acts or omissions that are based on the information that is published on the Website.

8.               Final remarks

Intergas has to change the Conditions from time to time. For instance, because the Website is changed or the legislation with regard to the protection of personal data and/or cookies is changed. Intergas may changes the Conditions unilateral and without prior notice to the users. The latest version of the Conditions can be found on the Website.

9.               Governing law and disputes

These Conditions are governed by Dutch law.

Any dispute arising from these Conditions, including any dispute regarding their existence and validity, will be settled by the competent court of Overijssel, Zwolle location.
